Currently, they offer the most predictive tool we have for assessing trial outcomes. That said, no study can account for every variable. Strong personalities (from counsel or parties), surprise rulings, or unexpected developments during trial can shift the outcome in ways data can’t fully capture. Think of Big Data as a powerful indicator, not a guarantee. It provides a solid foundation for decision-making, but human judgment still plays a crucial role.
