A strong argument can still fall flat if jurors aren't seeing the case through the right lens. Strategic framing influences how jurors perceive and interpret everything they hear. It defines who the story is about, what values are in conflict, and why the outcome matters. It makes your argument persuasive by aligning it with how people naturally think, not just what the law requires.
When should case framing begin in the life of a case? Chevron
Ideally, case framing begins early, at intake or during discovery. Starting early allows the frame to guide how you develop facts, which witnesses need to be emphasized or retained, and how you present evidence. Waiting until trial means missing key opportunities to shape how jurors view the case through the discovery process long before they enter the box. That being said, we often work on case framing after discovery is closed and during the trial preparation phase, and can make a drastic impact on how the case is perceived.
Does case framing affect damages or only liability? Chevron
It affects both. A strong frame helps jurors not only find for your client but also care about the outcome. When jurors see a larger principle at stake, they're more likely to award meaningful damages. Larger verdicts most often come from jurors wanting to make a statement or punish (with or without punitive damages) rather than solely compensating the injured party. Although the law seeks to separate liability and damages, in reality, they are closely intertwined.
